A Continuing Travesty of Justice

I can’t believe this is still ongoing:

Call it a farce, call it a travesty, call it legal loonie tunes. Paul Kelly still can’t get into the cabin he owns in Exeter near the Rhode Island Veterans Cemetery. He pays the taxes and pays the mortgage, but he can’t walk in the door.
“I’ve spent so much money,” says Kelly, “and I haven’t even gotten up to the plate yet.”
Kelly, who went to war in Iraq at the age of 51, not only can’t he get in his cabin, he can’t even stand up in court and say why it’s so crazy and unjust to keep him out.
He goes to court regularly with his lawyer, Pat McKinney. And he hears Judge O. Rogeriee Thompson grant yet another continuance before testimony can be heard. There were continuances in January, February and March.
The case of Paul Kelly-and-home-denied is scheduled for its next court go-round in May.

For those who aren’t familiar with the details, Kelly allowed a down-on-her-luck exgirlfriend to stay at his place while he went off to war. Upon his return, she filed a restraining order and refused to leave and has, apparently, been gaming the system ever since.

Shame on this woman. She is taking what does not belong to her.
Shame, shame on our court system for taking the side of a remora over a veteran. A returning veteran, no less.

Why can’t she be arrested for trespassing?
Frustrating just to read about, I can’t imagine how he must feel.

Wait a minute. Can someone explain this one to me? If someone is in my house, without my permission and that person’s name is not on the mortgage or the deed or the taxes, then why is this not trespassing? Otherwise, I’ll just wait until someone like David Cicilline isn’t home, break into his house, then file a restraining order against him. What’s the difference? Simply that Kelly once said it was ok for her to stay there? If I go the mall, I’m not trespassing, I’m allowed to be there. But if I do something against the mall’s rules, they can ask me to leave, and if I don’t, I can be found to be trespassing. Why isn’t she trespassing on his property since he doesn’t want her there and her name isn’t on the mortgage or taxes or title? Or is it?

Dammit, Patrick, you beat me to the punch.
I would have gone with Patrick Kennedy’s house, though. Or maybe Sheldon Whitehouse’s. Apparently he’s so rich, he’s refusing to release his tax returns. So in addition to living in a real nice house for a while, I’d be in line for a juicy settlement.

Didn’t anyone take notice of the prominent role of the latest nominee to the federal bench, Ojetta Rogeriee Thompson?
Someone posted on another forum that as a Cheerleader for Brown, she led the team off the court rather than stand for the National Anthem.
This woman is a just what you would expect for the RI Judiciary. In my opinion, she is another political hack who has demonstrated unwillingness to take the side of justice IF it will impact the “players” and politicians here in RI. Trust me on this, I have seen her in action.
She often does not go on record in the Court preferring to hold “sidebar conferences” or better yet, calling attorneys in her chamber. I guess that will preclude any record of her thought process being made for the record.
Unfortunately, thanks to Reed and Whitehouse, she will now be elevated to the First Circuit.
On a positive note, RI will finally be rid of her!

I am writing this as a 25 year old female from North Carolina . Back around 1997, I resided in Scituate RI with my father and brother. He started seeing a woman who claimed to be an Indian Princess and her name was Pocahantas. She moved in very shortly after they began dating, and often took me out special places, gave me special privledges to try and gain my trust (like getting me a kitten and making me sneak it into the house), and as a 12 year old I thought she was awesome. As time went by she would do funny things, like tell me my older brother was ‘snitching’ on my to my father, or tell my father I had been snooping in his room and I stole something, and she once told my grandmother that my brother wanted to go shoot me in the woods. Things got weird and my mother moved me out of the house for what she considered my safety. My father also had to leave his house and go to court, I believe to have her removed, the dates all posponed on her account. But right before he left she somehow either cut or disabled the brake lines to his truck. I also had an indoor cat that went “missing” right before I moved, even though she was so timid that she would not leave my room, nor go to anyone willingly. I guess what I am trying to say, is that this poor man Paul is not alone. Ms. Cooley’s brother admited to us, after she was out of our lives, that she had been mentally institutionalized in the past and he apologized for not ‘forwarning’ us.
